How & why was the case brought to the supreme court

The trial judge submitted the case to the jury, charging new york times that the comments were "libelous per se" and not privileged. The judge instructed the jury that falsity and malice are presumed. The jury awarded Sullivan $500,000. After this award was upheld by the Alabama appellate courts, the defendants appealed to the United States Supreme Court.
